Domestic Violence
These types of charges range from misdemeanors to the most serious felonies, and can affect immigration status, professional licensing and child custody disputes.  We recognize that accusations of domestic violence are often complicated and sensitive matters with intricacies that may not be obvious at first glance. Mental Health and Criminal Courts
People are often arrested and prosecuted in criminal courts for symptoms related to their mental illness.  Attorneys at Nolan Barton Olmos & Luciano understand the relationship between mental illness and perceived criminality, and we advocate for our clients using the expert opinions of psychologists, psychiatrists, and other mental health professionals to secure treatment and rehabilitation as an alternative to incarceration. Details

Sexual Offenses
The consequences of being charged with a sexual offense are severe. Although sexual offenses involving computers and the internet are often the starting points for many sex crime investigations, other cases begin with allegations including sexual battery, unlawful sexual intercourse, indecent exposure or sexual abuse of a minor.  We have experience with all types of cases and work with computer experts, medical doctors and other experts to craft the best defense. Felonies and Misdemeanors
In California, cases are charged as either felonies or misdemeanors.  Felonies are punishable by a state prison or county jail sentence of one year or more, while misdemeanors are punishable by one year or less in the county jail. Whether you are charged with a misdemeanor or the most serious felony offense, our firm is prepared to fight for the best possible outcome in your matter. Details

Three Strikes
The Three Strikes law severely increases punishments for defendants with past convictions for serious or violent felonies, known as “strikes.”  We’re prepared to fight these cases at trial but often use sophisticated negotiation and motion practice to convince prosecutors or judges not to seek a Three Strikes sentence, without the need for trial.   Our firm has defended these cases for decades and takes great pride in our history of successful advocacy for clients charged under this law. Motion Practice and Unlawful Searches
Motion practice is an important part of our firm’s criminal defense practice.  A successful motion can sometimes mean that the government can no longer present certain evidence and may be forced to dismiss specific charges or the entire case.  We litigate meritorious motions whenever possible and pride ourselves on our demonstrated research and writing abilities. Details

Juvenile Proceedings
We know that an encounter with police can be frightening for minors and unsettling for parents.  Our attorneys help families navigate the juvenile justice system and use restorative strategies to minimize the adverse impact on the child.  We always represent our clients’ interests, whether by mounting a robust legal defense or exploring rehabilitative measures to address the minor’s underlying conduct. Stanford Disciplinary Matters
School disciplinary cases can result in serious consequences for accused students.  We have a successful track record defending students in Title IX proceedings and alleged violations of school honor codes. Details

Reducing the Consequences of an Arrest or Conviction
After a person has been charged with or convicted of a crime, the full spectrum of relief consists of a lot more than just an appeal.  This relief can include a record clearance, early termination of probation, reduction of a felony to a misdemeanor, termination of registration requirements or even a pardon.  For cases where a person was arrested but never convicted, the arrest records may be sealed.  Our firm has extensive knowledge and experience helping people sanitize their criminal record. Details

Post-Conviction Relief for Immigration Purposes
California law permits a person who was convicted of a crime but not properly advised of the immigration consequences to challenge a conviction even years or decades after the court case has concluded. We work closely with skilled immigration attorneys to seek post-conviction relief to eliminate the immigration consequences of past convictions. Details
